This section aims to provide comprehensive information regarding how XTORE uses the personal data of its customers. XTORE, as the data controller, undertakes to comply with the legal provisions of Regulation (EU) No. 2016/679 of April 27, 2016, regarding personal data protection.

On the forms used to collect personal data on the website, the Customer is informed whether the data collection is mandatory or not. If any mandatory field is not completed, XTORE will not be able to provide its service.

1. WHO COLLECTS PERSONAL DATA?

3. WHO RECEIVES YOUR DATA? 

Your data is shared with XTORE's partners who may process the data on their behalf (they are recipients) or only for XTORE's account according to XTORE's instructions (these are subcontractors).

Data recipients include:

• Autoridade policial no quadro de pedidos judiciais no âmbito do combate à fraude;
• Serviços aduaneiros em caso de entregas no estrangeiro.

XTORE also uses subcontracted services for the following operations:

• Secure payments on websites and mobile applications;
• Fraud prevention and payment recovery;

• Website, application, and information system maintenance and technical development;
• Customer feedback collection;
• Email dispatch.

 XTORE may also share personal data in the future:

• In case of sale, transfer, or merger of the company or part of it, or if XTORE acquires or merges with another company;
• If such a transaction occurs, XTORE will ensure that the other party respects data protection laws.

 4. WHAT ARE MY RIGHTS REGARDING DATA?

4.1. What are my rights?

Under Articles 14 to 22 of Regulation 2016/679 of April 27, 2016, any individual using the service may exercise the following rights:

• Right of access;
• Right to rectification;
• Right to object and delete data processing;
• Right to object;
• Right to restriction of processing;
• Right to data portability.

Finally, if XTORE detects a personal data breach that poses a high risk to your rights and freedoms, you will be informed of the breach with all relevant details.

4.2. How can I exercise them?

These rights may be exercised with XTORE, which collected the personal data, by emailing hello@xtore.pt.

The request must be accompanied by proof of identity.

XTORE will respond within one month of exercising the right. In some cases, related to the complexity of the request or the number of requests, this period may be extended to two months.

4.3. What are the consequences of exercising the right to object?

In the event of exercising the right to object to profiling, the user is informed that they will continue to receive marketing communications, but these will be less relevant and will not result from segmentation based on the person’s interests.

4.4. What to do next?

5. WHAT HAPPENS TO MY DATA AFTER MY DEATH? 

The user may express, in advance, directives regarding the storage, deletion, and communication of their personal data after their death, in accordance with Article 40-1 of Law 78-17 of January 6, 1978. These directives may be general or specific.

Fica informado de que os seus dados pessoais podem ser transmitidos, com a finalidade de dar resposta aos objetivos acima descritos, a empresas situadas fora da União Europeia. Antes da transferência para fora da União Europeia, e conforme a lei em vigor, a XTORE implementa todos os procedimentos exigidos para obter as garantias necessárias à segurança de tais transferências.

7. HOW LONG ARE MY DATA STORED? 

XTORE will retain/store users' personal data related to orders for a period of 5 years.

8. WHAT SECURITY MEASURES ARE IN PLACE TO PROTECT MY DATA? 

8.1. General rules

As the data controller, XTORE takes all necessary precautions to preserve the security and confidentiality of the data, specifically to prevent it from being altered, damaged, or accessed by unauthorized third parties.

When using subcontractors, XTORE ensures that they comply with data protection laws.

 8.2. Rules applicable to banking and credit card data

To ensure the security of payments, XTORE uses the services of the provider EuPago. 

When you place an order at XTORE and choose to pay with a credit card, our system connects in real-time to the system that collects your data and performs various checks to prevent abuse and fraud. The data is stored on EuPago's servers and is never transmitted to XTORE's servers. EuPago requests authorization from the bank and transmits a transaction number to us, allowing operations for the amount of the authorization. 

To debit the account during the order or credit it during a return, EuPago retains the banking data associated with the authorization number for the time necessary to complete the transaction and to handle any potential claims (returns, disputes).

8.3. Combatting online fraud

To ensure the security of payments and deliveries and to provide you with a better quality of service, the personal data collected on the site is also processed by XTORE to determine the level of fraud risk associated with each order and, if necessary, to help adjust the execution conditions accordingly. 

9. ARE DATA OF INDIVIDUALS UNDER 18 YEARS OLD COLLECTED?

According to the general terms and conditions of sale, individuals must be at least 18 years old to make purchases on this website. 

10. WILL I RECEIVE MARKETING COMMUNICATIONS?

10.1. Principles applicable to XTORE
